A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without legal authority.

"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.

The situation originates in a erroneous removal to El Salvador in March, which US authorities later admitted was an error. After his repatriation to the United States to face human smuggling allegations, he was held in immigration detention.

In her order, the court pointed out that the government does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
